Reports are available for copy for $3.00 per report. If you have been issued a citation by the Elberton Police Department on a charge that does not mandate an appearance in court, you have the choice of appearing in court on the court date written on the front of your citation, or posting a pre-set bond on the charge before court which will then be forfeited if you do not appear. A bond forfeiture holds no adverse penalties for non appearance, but does hold the same consequences as a guilty plea. If you plan to plead not guilty or enter a special plea you must come to court. If you plead not guilty, your case will be re-set for trial at a later date. Anyone under the age of 21, when the citation was issued, may not pay the citation in advance and must appear in court. Persons 16 years of age and younger must appear in juvenile court. Anyone failing to pay in advance and failing to show up in court will have a bench warrant issued for failure to appear. This will add $100.00 to the fine amount and may result in arrest. All bench warrants will be placed on the NCIC/GCIC computer showing the person has an active warrant for their arrest. If you have been charged with no proof of insurance, you must provide proof that insurance was in effect on the date and time you were stopped. If you can not provide that proof, you will be charged with no insurance resulting in a higher fine and possible suspension of your driver’s license. You may pay your fine either in person, by mail, or by phone. If paying over the phone, you may use your debit or credit card. Payments made in person should be made at the City of Elberton Customer Service Center located at 230 N. McIntosh Street, Monday – Friday, 8:00 a.m. until 5:00 p.m. If making a payment by mail, you may send the actual ticket, a copy of the ticket, or put the citation number on your check, money order, or cashiers check and mail to P. O. Box 70, Elberton, GA 30635. If you wish to receive a receipt for your payment, please include a stamped, self-addressed envelope. In order to insure that your citation is in the system, please allow 3 business days before making your payment. If paying on the day of court, you must pay NO LATER THAN 1:00 p.m. to insure that your payment will be processed before court. Payments made after 1:00 p.m. could result in a bench warrant being issued for your arrest. Checks and money orders must be made payable to the Municipal Court of Elberton. Make sure your payment reaches the City of Elberton Police Department prior to your court date. The City of Elberton Municipal Court is held at City Hall located at 203 Elbert Street, Elberton, GA 30635. COURTROOM RULES... There is a dress code in Municipal Court. No excessively short shorts, halter-tops, or hats of any kind are allowed. In addition, shirts and shoes are required. Casual or business dress is suggested. Also, no weapons (including small pocket-knives) are allowed in the Courtroom. Please do not bring small children or babies to court with you. Due to limited space, only the defendant and one family member will be allowed in the courtroom. Other family members may wait outside. All electronic devices, such as cell phones, pagers, & etc. must be turned off or muted. Please follow all instructions given to you by the staff.
